There’s lots of questions at stake here which requires context. If you work with hamburgers, it can be seen as theft. If your firm doesn’t have anything to do with hamburgers, there may be a bit of a problem. You can’t tell people what they can’t eat, and employees are legally able to do what they like on their time off including rest breaks on site. You might not like it and it might be contrary to your beliefs but your employee has the right to be free too. You need to provide a space for them to do this so that it doesn’t interfere with your other activities, or have a policy for them when they leave site so that it doesn’t affect your business. But if they’ve eaten somewhere in an area that they’re not supposed to like a preparation room then that does give you grounds for dismissal no matter what time of day it is.
